content representations and Liabilities

NIWA disclaims any and all liability in connection with the content of its authors’/members’ books. Authors are solely responsible for the content and the consequences of their books. By providing your book for promotion on our website and at cons and events, you affirm, represent, and warrant that:
  1. You are the creator and owner of the book(s).
  2. The content in your book(s) is appropriate for the genre you have selected and could not be deemed by a reasonable person to be profane, illegal, harassing, threatening, hateful, or otherwise inappropriate for the genre.
  3. Your book(s) does not and will not contain Hateful Propaganda or Harassment.

The following serves as a guide to help illustrate generally the types of content that fall within the scope of NIWA’s policy on Hateful Propaganda and Harassment, but is not exhaustive. For the avoidance of doubt, your book(s) may not include, and NIWA may remove or refuse to promote any book(s) that violates the terms.

Hateful Propaganda includes:
  • Any statement, image, photograph, or other content that in our sole judgment could be reasonably perceived to incite to harm, threaten, demean, promote the harassment of, promote the intimidation of, or promote the abuse of others for any reason, including by reason of race, gender or gender identity, national origin, sexual orientation, religion, or political affiliation.
  • Additionally, any statement, photograph, advertisement, or other content that in our sole judgment could be reasonably perceived to evoke sympathy* for known perpetrators of hate crimes such as the Ku Klux Klan, Nazi Party, Charles Manson etc. and causes/agendas such as these.
*Note: there is a difference between sympathizing with a character who happens to be conscripted into service vs sympathizing with “the cause” or its “agenda.”

Harassment includes:
  • Revealing someone’s personal information, also known as “doxing”.
  • Online stalking, and bullying.
  • Wishes for physical harm directed at a person or persons.
  • Incitement of others to any of the previous items.

NIWA reserves the right to suspend or terminate promotion of book(s) which contain Hateful Propaganda, or Harassment.

NIWA may also suspend or terminate an author’s membership if the author posts on NIWA’s Facebook page posts violating NIWA’s Hateful Propaganda and Harassment policy or if the author engages in such conversations during a NIWA sponsored event.

Notwithstanding the foregoing, NIWA reserves the right to screen and remove any book we find in violation of these Terms or that we find, in our sole discretion, to be otherwise objectionable.

NIWA is not responsible for finding and vetting all content. However, should content be reported, NIWA’s Board will assign a committee to investigate the allegation before taking any action or removing any book.
